Workers Comp Retaliation
Cases under the workers’ comp anti-retaliation, anti-discrimination and wrongful termination or discharge law often are labeled as “whistleblower” claims, just as are federal False Claims Act cases (via qui tam lawsuits) that seek a reward or bounty for reporting fraud on the U.S. government. Found in the Texas Labor Code, this workers compensation law protects the injured worker – as well as those who assist that worker – from being fired or otherwise discriminated against in any way because of filing or helping with any workers’ comp claim.
Because Texas is a so-called “right-to-work” state, employees have few state-law protections against wrongful terminations and other discriminatory treatment. Thus, employers often successfully hide the real reason for their illegal “personnel actions” – the workers’ comp claim – by using a pretext or “smokescreen” like “R.I.F.” (“reduction in force”), and creating a veritable mountain of paperwork to justify the misdeed. Or, to “run off” the worker, the employer succeeds in making the worker’s life miserable, thereby triggering a “constructive discharge” that still entitles legal relief under certain circumstances.
Uncovering and then exposing the employer’s true motives takes smart, strong yet competent legal help very early on, if the evidence is to be preserved and the victim’s rights are to be vindicated. Only an intelligent, aggressive but highly skilled Texas workers compensation lawyer and advocate, who knows how to prove the client’s case and then access a fair judge and jury for that client, can ensure that these tough, hard-fought cases are prepared expeditiously, intelligently and properly.
