Defective Products

Products liability accidents from product defects in Texas, dangerous products and goods, and food poisoning or contaminated foodstuffs can be divided into cases of (1) defective design, (2) defective manufacture or (3) defective marketing or inadequate warnings.

The 1st involve such diverse scenarios as child carseat or seatbelt injuries, crib deaths, automobile rollovers, tire blowouts, machine malfunctions and unsafe workplace equipment, to name but a few. Generally, Texas law requires proof that the defect existed when the product was sold.

The 2nd require proof that something was not made the way it was designed. Lastly, the 3rd include lack of warnings that an infant could be hurt if a baby product is not used in a certain way; that gas water heaters can cause carbon monoxide poisoning and death; or that a consumer product must be used with goggles or other eye protection.
